GENERAL SALES CONDITIONS

Scope of Application The present conditions apply to the sale of products by Select-Wines Sarl from its online store Millésimes-Online.com, accessible through the Internet, whose headquarters is at BP3 95590 Presles, registered at the Commerce and Business Registry under the number 479,583 544, hereinafter known as “www.millesimesonline.com”. They are automatically made available to the buyer on the home page of the website www.millesimesonline.com. The buyer needs only to click on "General Sales Conditions" (hereinafter known as G.S.C.) to attain the ordering conditions, before beginning the order process. As a consequence, the placement of an order implies full and unrestricted compliance of the buyer to the G.S.C. In the absence of particular stipulations agreed upon in writing between the parties, all orders are submitted to the full force of the present general sales conditions, that prevails over any other document, whether it be a prospectus, press, catalogue, or email sent by the vendor, having a single indicated value. The language of the present contract is French. All clauses of the present General Sales Conditions, all transactions and purchase operations made from the site www.millesimesonline.com as well as by mail and telephone are covered by French laws and regulations. All disputes not resolved amicably will be moved to the Tribunal of Pontoise, the city of the company's headquarters.

Pricing The prices indicated are denominated in Euros, are tax inclusive and not including shipping and handling fees. They notably include the applicable VAT, excises and all other applicable taxes. Save for sales and without agreement, subject to typographical and posting errors. Certain references will the object of a minimum of orders. This particular condition is clearly specified on the site for each of the relevant conditions.

Payment Payment of merchandise is made upon ordering and only by credit card (Carte bleue, Visa, MasterCard), Paypal® or by check sent to the address of the headquarters of the company addressed to “Select-wines Sarl”. A secure credit card payment system has been implemented on the site. This procedure relies on information coding technology, the standard in securitized payment. Upon payment, you enter your credit card number and expiration date, which are also encrypted on your computer before being transmitted over the Internet. Thus, any confidential information will not circulate on the web without being encrypted beforehand. The client guarantees that s/he is fully authorized to use the credit card being used and that the card has access to sufficient funds to cover the costs of the order.

The Order www.millesimesonline.com agrees to accept orders within the terms of the present General Sales Conditions and within the available stock limits. www.millesimesonline.com will honor the ordered products with one or more shipments according to availability at the time of the order. In order to be valid, the order must be placed over the Internet and only on the site www.millesimesonline.com. No order will be considered without payment by our banking entity (BNP Paribas). www.millesimesonline.com reserves the right to annul all non-conforming or doubtful orders, as well as those made by clients with whom a payment dispute exists from a previous order.

Availability and Validity of Offers The products and prices shown are valid within the limit of available stock. In the case of unavailability of one or more products after validating the order, www.millesimesonline.com agrees to notify the client by email or telephone of the partial or total annulment of the order. In the case in which the transaction has already been debited from a member's bank account, www.millesimesonline.com will proceed with the shortest delay possible to reimburse the undelivered product(s), crediting the credit card used for the order payment. www.millesimesonline.com will not be held responsible for any stock backups that incur a delay in an order's shipment.

Shipping Shipments are made all over the globe. The wine travels in conditions suitable for wine shipment, at the cost, risk, and peril of the client. Upon receiving the merchandise, it is the receiver's responsibility to verify the state of the merchandise upon receipt and to make any necessary observation in the case of breakage, harm, or missing items, noting the stock on the freight note, and within the 48 hours following receipt of the merchandise, and by certified mail with the statement of receipt through the transporter, with a copy to the vendor, in order to maintain its rights. The shipping time of orders is an average of 10 days after order validation. Because shipment times vary, they are not specified at the time of the order.
Longer shipment times do not incur damages and interest, or the revocation or annulment of the order in progress. However, if one month after written complaint from a client, the merchandise has still not been delivered, the sale may then be resolved by one or both parties. The client will obtain a reimbursement of payment without damages or interest, within one month. In any case, shipments in progress cannot be intercepted without the client communicating to the vendor the exact information on the receiver's address. In the case of an error, www.millesimesonline.com will not be made aware of being responsible for the impossibility of delivering the merchandise to the place and time desired.

For shipments abroad and to French overseas territories, shipment fees are calculated by the number of bottles sent. They are charged and may be changed for each sale.

Any customs costs remain the responsibility of the client.
